These Terms & Conditions (“Terms”) govern your access to and use of www.datasanitizationpro.com, our software products, data erasure solutions, professional data sanitization services, media destruction services, reports, certificates and related content.
In these Terms, “Data Sanitization,” “Data Sanitization Pro,” “Company,” “we,” “us,” and “our” refer to the business entity providing the relevant website, software or service.
By accessing our website or using our services, you agree to these Terms. If you do not agree with them, please do not use the website or services.
For customers purchasing software or professional services, these Terms may be supplemented or replaced by a quotation order form, licence agreement, statement of work, service agreement or other written contract. Where there is a conflict, the applicable written commercial agreement will govern the relevant service or transaction.

The exact services, supported devices, quantities, turnaround times, deployment options and deliverables will depend on the relevant quotation order, licence or service agreement.
3. Data Erasure and Media Processing
Important Information About Secure Data Erasure
Data erasure is performed using methods appropriate to the storage technology, device capabilities and agreed processing requirements.
Depending on the media, available functionality may include supported methods such as:
- NIST SP 800-88-based approaches
- Secure Erase
- Supported SSD/NVMe sanitization methods
- DoD 5220.22-M where specifically required and technically appropriate
- HMG IS5
- Other supported erasure methods
- Organization-specific or custom policies where supported
Not every erasure method is appropriate for every storage technology.
For example, modern SSD and NVMe devices may require storage-aware sanitization techniques rather than relying exclusively on traditional HDD overwrite procedures.
4. Verification
Where the selected process supports verification, we may perform verification checks to establish whether the configured erasure operation completed successfully.
Verification results may be recorded in the applicable report or certificate.
However, verification is subject to:
- Device condition
- Storage technology
- Device accessibility
- Firmware and controller behavior
- Selected erasure method
- Hardware failures
- Technical limitations
A device that cannot be successfully processed or verified may be recorded as an exception and may require physical destruction instead.
5. Data Erasure Certificates and Reports
Where included in the applicable service or software workflow, we may provide data erasure certificates or reports containing information such as:
- Device identification
- Serial number
- Asset information
- Storage capacity
- Erasure method
- Processing status
- Verification result
- Processing dates and times
- Operator information
- Relevant audit information
A certificate or report documents the processing performed according to the applicable workflow.
It should not be interpreted as a guarantee that every possible future recovery technology is incapable of recovering information.
Customers are responsible for determining whether the documentation supplied meets their specific contractual, regulatory, audit or internal-policy requirements.
6. Customer Responsibilities
Before submitting equipment for data erasure or destruction, the customer is responsible for ensuring that:
- They have the legal right to authorize processing of the equipment.
- They have authority to request erasure or destruction of the data.
- Any data required for legitimate business, legal or regulatory purposes has been retained before processing.
- Required backups have been completed where applicable.
- Devices are accurately identified where asset information is available.
- Any required passwords, encryption keys, access credentials or device information are provided where necessary for the agreed service.
- Equipment is packaged and transported safely when the customer is responsible for transportation.
- The customer communicates any special handling requirements before processing begins.
Once a data erasure process begins, data may become permanently inaccessible.
Customers should therefore ensure that required information has been backed up or retained before requesting erasure.
8. Pricing, Quotes and Payment
Pricing for software, licensing, data erasure, on-site services, physical destruction and other professional services may be provided through a quotation or commercial proposal.
Unless otherwise agreed in writing:
- Prices are subject to the scope stated in the quotation.
- Applicable taxes, including GST, may be charged as required by law.
- Payment terms will be specified in the applicable quotation or agreement.
- Additional work outside the agreed scope may be charged separately.
- Delayed payments may result in suspension of services or other remedies permitted under the applicable agreement.
- Software licence fees are subject to the applicable licence terms.
For completed data erasure or destruction work, refunds are generally not available where the service has already been performed, except where expressly agreed in writing or required by applicable law.
9. Software Licensing
Data Sanitization Pro is licensed, not sold.
Your right to use the software depends on the licence purchased and the applicable licence terms.
Depending on the selected plan, licensing may be based on factors such as:
- Number of devices
- Device credits
- Organization or enterprise deployment
- Site or department requirements
- Government or institutional requirements
- Licence duration
You may not:
- Resell or redistribute the software except under an authorized reseller or partner arrangement.
- Reverse engineer, decompile or attempt to extract source code except where permitted by applicable law.
- Circumvent licensing or activation controls.
- Remove proprietary notices.
- Use the software beyond the scope of the purchased licence.
- Share licence credentials or activation information with unauthorized users.
Additional terms may apply to partners, resellers and white-label customers.
10. Software and Service Availability
We aim to provide reliable software and services, but we do not guarantee that:
- The website will always be available.
- The software will operate without interruption.
- Every storage device will be supported.
- Every device will successfully complete an erasure process.
- Every third-party system will remain compatible.
- Online services will always be available.
- Hardware or firmware limitations will never affect processing.
Software functionality may change as we improve security, compatibility, performance and supported technologies.
11. Data Erasure Limitations
We use commercially reasonable technical processes designed to securely erase supported storage media.
However, no data erasure provider can reasonably guarantee protection against every possible future recovery technique, undiscovered vulnerability, hardware behavior or technology that does not currently exist.
The outcome may also be affected by:
- Damaged storage media
- Failed controllers
- Firmware problems
- Encryption
- Device locks
- Unsupported hardware
- Unreadable storage
- Physical damage
- Hidden or inaccessible storage
- Manufacturer-specific limitations
Where secure erasure cannot be reliably completed, we may recommend or perform physical destruction where included in the agreed service.
12. Physical Media Destruction
Physical destruction may be recommended where software-based erasure is not technically appropriate or cannot be successfully verified.
Depending on the agreed service, destruction may include suitable processes for:
- Hard disk drives
- SSDs
- Flash media
- Memory cards
- Storage components
- Other supported data-bearing media
Destruction documentation will describe the applicable disposition.
Erasure and destruction are different processes and will not be represented as the same outcome.
13. On-Site Services
Where on-site data sanitization or destruction is requested, the service will be subject to the agreed scope and site conditions.
The customer is responsible for providing:
- Reasonable access to the equipment
- A safe working environment
- Required site permissions
- Appropriate power and infrastructure where necessary
- Access to equipment identified in the service scope
- Any security or safety instructions that must be followed
Additional charges may apply where site conditions, waiting time, equipment quantity or project requirements materially differ from the agreed scope.
14. Confidentiality
We understand that customers may provide confidential business, technical and operational information during the course of a project.
We will use reasonable measures to protect confidential information received in connection with our business relationship.
Confidential information may be disclosed where:
- Required by law
- Required by a court or regulatory authority
- Necessary to provide an agreed service
- Provided to authorized employees, contractors or service providers under appropriate confidentiality obligations
- The information has become publicly available without breach of an obligation
Where a separate NDA or confidentiality agreement exists, its terms will apply according to that agreement.
15. Data Privacy
Information provided to us is handled in accordance with our Privacy Policy and applicable data protection requirements.
Our Privacy Policy explains how we collect, use, disclose, retain and protect personal information.
Customers using our data erasure services remain responsible for determining their own obligations concerning the personal data contained on equipment they submit to us.
Where applicable, customer contracts or data-processing agreements may establish additional responsibilities.
16. Intellectual Property
All intellectual property associated with our website, software and services remains owned by Data Sanitization or the relevant third-party rights holder unless expressly stated otherwise.
This may include:

21. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our website and general information are provided on an “as available” and “as is” basis.
We do not guarantee that the website, software or services will always be uninterrupted, error-free or compatible with every hardware configuration.

Where liability cannot be excluded, our aggregate liability will, subject to applicable law and the relevant written agreement, generally be limited to the amount paid for the specific service or product giving rise to the claim.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot legally be excluded or restricted.
23. Customer Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Data Sanitization, its employees, contractors and authorized representatives from claims, losses, liabilities and reasonable expenses arising from:
- Your unlawful use of the website or services
- Your breach of these Terms
- Your lack of authorization to submit equipment or data
- Your violation of third-party rights
- Your misuse of the software
- Your violation of applicable law
This provision does not apply to the extent a claim results from our own conduct for which we are legally responsible.
24. Compliance Responsibilities
Our software and services may help organizations implement their own data disposal and security processes.
However, using Data Sanitization Pro or any individual data erasure service does not by itself make an organization compliant with a particular law, regulation, certification or industry framework.

- Establishing appropriate data retention and disposal policies
- Selecting appropriate sanitization methods
- Maintaining required documentation
- Meeting contractual and regulatory obligations
- Determining whether supplied certificates and reports meet their audit requirements
Our software and services can provide technical capabilities and supporting evidence, but compliance ultimately depends on the customer's complete policies and processes.
